(Scroll down for video) Two Israeli Arabs, who are brothers, were arrested and charged with larceny related charges after they stole a $5 million lottery ticket from a customer of their father’s store in New York, according to court proceedings in New York.

Now, a judge has dismissed some of the charges against the two who stole the lottery ticket of a New York man, ruling that the alleged theft was beyond the statute of limitations.

A local New York newspaper reported Tuesday that the judge of the Onondaga County Court confirmed other charges against Andy Ashkar and Nayel Ashkar.

Prosecutors said the brothers took the winning ticket from a customer who bought it at a convenience store in Syracuse from their father in October 2006. Authorities said that Andy Ashkar told the customer he had won $5,000 and gave him $4,000 in exchange for the ticket.

The Ashkars waited until March 2012 to claim the top prize in the state lottery office.
“People buying lottery tickets need to be very careful when checking their lottery tickets with the store clerk. It is best to check for winning tickets yourself,” Antonia Stinson, 39, of Albany, New York told YourJewishNews.com after learning about the charges.

The brothers still face charges of conspiracy and are scheduled to go to trial next week.Mobile video not loading? Click here to view
