(Scroll down for video) An obese man sued his favorite restaurant after his big belly did not fit into the booth.
Martin Kessman, 64, from Rockland County, New York filed a lawsuit against White Castle, claiming the company is violating his rights by not having booths that are large enough to accommodate his larger body.
According to the lawsuit, the 290 pound man, visited his favorite local White Castle in Nanuet, Rockland County. When he tried to sit in a booth, he hurt his knees on a metal bar while trying to get into the chair. The booths are not adjustable because they are bolted down to the floor. Kessman left the restaurant and complained to corporate headquarters.
The lawsuit alleges that Kessman received a response to his complaints, and he was offered coupons for free burgers. He was also promised that the situation will be resolved by accommodating larger people.Kessman filed his lawsuit after seeing that the restaurant had not changed their seating arrangements. He demanded larger booths and unspecified damages.
“The response of this man should have been one of concern for his own health. He should try to lose weight so he can fit into the booth rather than moving the table so he can gain more weight,” Michele Jefferson, 72, from Rockland County, New York told YourJewishNews.com.
Kessman lost the lawsuit in Manhattan federal court. He was not awarded any money.
As a result of the case, White Castle decided to replace the booth with a table and chairs that are not bolted to the floor.
